Chapter 7 "liquidation" Bankruptcy offers a clean financial slate. If you qualify, all of your debt from credit cards, medical bills and other unsecured loans may be wiped away. Our experienced lawyer will guide you through the bankruptcy process:

  • First, we will explain the means test and determine whether or not you are eligible to file for Chapter 7. If you do not meet the means test, a Chapter 13 "reorganization" Bankruptcy may be an option.
  • Once we have determined that you qualify, we will file the proper paperwork with the bankruptcy court.
  • An automatic stay will immediately go into effect. Creditors will no longer be able to harass you or try to collect on your debts.
  • Approximately 30 days after the filing, we will attend a meeting of your creditors with you.
  • You will need to attend debt counseling prior to filing for bankruptcy and after filing for bankruptcy in order to present a certificate from the counseling service to the Court.
  • The deadline for creditors to file objections is usually two months after this meeting.
  • Within a few weeks of that deadline, the bankruptcy court will issue a debt discharge notice.

With a Chapter 7 Bankruptcy discharge, most of your unsecured debt will disappear. You will not be responsible for paying those debts anymore, and you can begin to rebuild your credit. Although certain debts such as taxes, support obligations and most student loans cannot be discharged, filing for bankruptcy often provides significant relief.
