For many people in the South Mississippi area, Chapter 13 Bankruptcy is the best debt relief option available. Unlike a Chapter 7 Bankruptcy, you will still need to pay back many of your debts, but you will be able to pay them back on a schedule that works for you.
The first step of the Chapter 13 Bankruptcy process is determining how much you can afford to pay each month. This is how we come up with that figure:
- Our first step is to understand your monthly income.
- If you want to keep your home or car and can afford the payments, we will determine the amount you will need to keep paying each month outside of your bankruptcy plan.
- We will add up your monthly expenses for food, utilities and other necessities.
- The amount left over after monthly debts and expenses will be used to determine your required bankruptcy plan payment.
We will help you come up with a monthly amount to be paid and determine how long the plan will last. Chapter 13 plans continue for three to five years. After the plan, any remaining qualifying debt may be discharged.
You will need to attend debt counseling within 180 days before filing for bankruptcy and again prior to discharged. And certain unsecured debts such as taxes or child support cannot be discharged.
